sole proprietor LLC wants to pay, and her husband?
I am the sole owner of an LLC in Michigan, doing video production. The year Last was the first year of business with a loss. This year, things picked up, but not enough to pay me a "salary". My husband made the camera and editing for the company. When one of us is paid, it goes into a common pot. I need to be able to pay one or two of us as soon as possible! I am afraid that if I pay for my husband as a contractor, it will look "suspicious" to the IRS, because he is my husband. I read that the LLC is still regarded as unique, and the spouse "automatically" owns half profits, regardless of whether or not they are a manager or member. The question is: Can I pay her editing and camera work (1099?) And I can take a "draw" instead of paying myself a salary? Would it be better to add it as a member too, and pay him a "draw"?
If you file a joint declaration with your husband, paying him with a 1099 does nothing but make the return a little more complicated and opens be required to have a license.
